Important: Please read these rules before entering any Tetris Party Tournament (the "Tournament").

The Tournament is a game of skill.

  1. 1. Eligibility.

    Top
    TERRITORY #1: EACH TOURNAMENT IN TERRITORY #1 IS OPEN ONLY TO RESIDENTS OF THE U.S. (EXCLUDING ALASKA, ARIZONA, ILLINOIS, IOWA, LOUISIANA, AND PUERTO RICO) AND CANADA (EXCLUDING QUEBEC), WHO ARE OVER THE AGE OF 13. IF YOU ARE NOT A RESIDENT OF THESE AREAS OR NOT OVER THE AGE OF 13, YOU ARE NOT ELIGIBLE TO WIN A PRIZE, AND TETRIS ONLINE, INC. ("SPONSOR") RESERVES THE RIGHT NOT TO AWARD PRIZES TO YOU.

    TERRITORY #2: EACH TOURNAMENT IN TERRITORY #2 IS OPEN ONLY TO RESIDENTS OF THE EUROPEAN UNION, AUSTRALIA AND NEW ZEALAND WHO ARE OVER THE AGE OF 13. IF YOU ARE NOT A RESIDENT OF THESE AREAS OR NOT OVER THE AGE OF 13, YOU ARE NOT ELIGIBLE TO WIN A PRIZE, AND TETRIS ONLINE, INC. ("SPONSOR") RESERVES THE RIGHT NOT TO AWARD PRIZES TO YOU.

    Directors, officers and employees of Sponsor, The Tetris Company LLC, and any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, and immediate families of each are not eligible to win any prizes. All applicable federal, state and local laws and regulations apply. VOID WHERE PROHIBITED. Limit one (1) entry per person per Tournament per Wii system. All additional, other, and/or subsequent entries will be disqualified.
  2. 2. How to Enter and Participate.

    To enter a Tournament, you must: 1) register online; 2) play the Tetris Party WiiWare game using your Nintendo Wii console; and 3) enter your results online, as follows:

    1. Step 1.   Register: To register, follow the steps below:
      • Visit www.tetrisparty.com/tournament on the Internet;
      • Complete the online registration form by including your name, e-mail address, and other requested information;
      • You only need to register online once to participate in any or all of the Tournaments. It is not necessary to re-register for each Tournament.
      • All requested information must be provided for your registration (and subsequent entry) to be valid. By registering for a Tournament, you consent to being placed on a mailing list for promotional and other purposes. However, you may opt-out of receiving promotional e-mails from Sponsor upon receipt of the first such e-mail by following the "unsubscribe" instructions in the message.
    2. Step 2.   Play: To participate in a Tournament, you must purchase and download the Tetris® Party game from the Nintendo Wii Shop Channel, then follow the steps below before the end of any round (defined below) of the Tournament you wish to enter to play:
      • Visit the "Nintendo Wi-Fi Connection" page on the Main Menu of Tetris Party Game with your Nintendo Wii Console;
      • Select the "Tournament" option on the "Nintendo Wi-Fi Connection" page;
      • Select the "Tournament Deadline" option and play the Tetris® Party game during at least one of the rounds of the Tournament. (Start and end dates/times for each round are listed below.) (Note: In a multi-round Tournament, your top result from each of the four rounds will be combined if you enter your "Confirmation Codes" for each round as explained below. However, each round must be played on the same Nintendo Wii console to combine your results from different rounds.);
      • Select "Tournament Ranking" from the Tournament Menu Page;
      • Select the appropriate Tournament Round and select "Update" to submit your result.
    3. Step 3.   Enter: To Enter:
      • Visit the "Nintendo Wi-Fi Connection" page on the Main Menu of Tetris Party Game with your Nintendo Wii Console;
      • Obtain your "Confirmation Code" from the "News" section of the Nintendo Wi-Fi Connection page at the end of each of round played. (Note: Your "Confirmation Code" contains embedded information about your Wii's Mac Address and will only be accessible in the "News" section of the Nintendo Wi-Fi Connection page for twelve (12) days after the end of each round.)
      • Visit www.tetrisparty.com/tournament;
      • Submit your "Confirmation Code(s)" within twelve (12) days after the end of each round you play by following the directions on www.tetrisparty.com/tournament.
  3. 3. Disclaimer.

    Sponsor, The Tetris Company LLC and all participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies (collectively, the "Participating Entities") will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Tournament disruptions, injuries, losses or damages caused by events beyond the control of Sponsor; or (d) any printing or typographical errors in any materials associated with the Tournament.
  4. 4. Tournament Periods.

    TOURNAMENT #4: The Tournament #4 Period is from 00:00 GMT on April 16, 2009 to 23:59 (GMT) on April 30, 2009 (the "Deadline" for Tournament #4).

    TOURNAMENT #3: The Tournament #3 Period is from 00:00 GMT on February 16, 2009 to 23:59 (GMT) on April 15, 2009 (the "Deadline" for Tournament #3). The Tournament contains four rounds as described below:

    Round 1: Starts February 16, 2009 at 00:00 GMT and ends February 28, 2009 at 23:59 GMT
    Round 2: Starts March 1, 2009 at 00:00 GMT and ends March 15, 2009 at 23:59 GMT
    Round 3: Starts March 16, 2009 at 00:00 GMT and ends March 31, 2009 at 23:59 GMT
    Round 4: Starts April 1, 2009 at 00:00 GMT and ends April 15, 2009 at 23:59 GMT

    In each Tournament, you must enter the "Confirmation Code" for each round within (12) days following the end of that round. If you do not correctly enter your "Confirmation Code" for a round within this time period, your actual result for that round will be treated as a zero and will not be counted toward your total result.

    TOURNAMENT #2: The Tournament #2 Period is from 00:00 GMT on February 1, 2009 to 23:59 (GMT) on February 15, 2009 (the "Deadline" for Tournament #2).

    TOURNAMENT #1: The Tournament #1 Period is from 00:00 GMT on December 1, 2008 to 23:59 (GMT) on January 31, 2009 (the "Deadline" for Tournament #1). The Tournament contains four rounds as described below:

    Round 1: Starts December 1, 2008 at 00:00 GMT and ends December 15, 2008 at 23:59 GMT
    Round 2: Starts December 16, 2008 at 00:00 GMT and ends December 31, 2008 at 23:59 GMT
    Round 3: Starts January 1, 2009 at 00:00 GMT and ends January 15, 2009 at 23:59 GMT
    Round 4: Starts January 16, 2009 at 00:00 GMT and ends January 31, 2009 at 23:59 GMT

    In each Tournament, you must enter the "Confirmation Code" for each round within (12) days following the end of that round. If you do not correctly enter your "Confirmation Code" for a round within this time period, your actual result for that round will be treated as a zero and will not be counted toward your total result.
  5. 5. Prizes.

    TOURNAMENT #4:
    Territory #1: The prize ("Prize") is 1,200 Wii Points (approximate value $12.00 USD). One hundred (100) Prizes will be awarded (approximate value $1,200.00 USD), one to each of the top 100 eligible entrants from Territory #1. Final ranking is calculated by combining points awarded based on each entrant's result-based ranking for each round of the Tournament.
    Territory #2: The prize ("Prize") is 1,200 Wii Points (approximate value 12 Euros). One hundred (100) Prizes will be awarded (approximate value 1200 Euros), one to each of the top 100 eligible entrants from Territory #2. Final ranking is calculated by combining points awarded based on each entrant's result-based ranking for each round of the Tournament.

    TOURNAMENT #3:
    Territory #1: The prize ("Prize") is 1,200 Wii Points (approximate value $12.00 USD). Five hundred (500) Prizes will be awarded (approximate value $6,000.00 USD), one to each of the top 500 eligible entrants from Territory #1. Final ranking is calculated by combining points awarded based on each entrant's result-based ranking for each round of the Tournament.
    Territory #2: The prize ("Prize") is 1,200 Wii Points (approximate value 12 Euros). Five hundred (500) Prizes will be awarded (approximate value 6000 Euros), one to each of the top 500 eligible entrants from Territory #2. Final ranking is calculated by combining points awarded based on each entrant's result-based ranking for each round of the Tournament.

    TOURNAMENT #2:
    Territory #1: The prize ("Prize") is 1,200 Wii Points (approximate value $12.00 USD). One hundred (100) Prizes will be awarded (approximate value $1,200.00 USD), one to each of the top 100 eligible entrants from Territory #1. Final ranking is calculated by combining points awarded based on each entrant's result-based ranking for each round of the Tournament.
    Territory #2: The prize ("Prize") is 1,200 Wii Points (approximate value 12 Euros). One hundred (100) Prizes will be awarded (approximate value 1200 Euros), one to each of the top 100 eligible entrants from Territory #2. Final ranking is calculated by combining points awarded based on each entrant's result-based ranking for each round of the Tournament.

    TOURNAMENT #1:
    Territory #1: The prize ("Prize") is 1,200 Wii Points (approximate value $12.00 USD). Five hundred (500) Prizes will be awarded (approximate value $6,000.00 USD), one to each of the top 500 eligible entrants from Territory #1. Final ranking is calculated by combining points awarded based on each entrant's result-based ranking for each round of the Tournament.
    Territory #2: The prize ("Prize") is 1,200 Wii Points (approximate value 12 Euros). Five hundred (500) Prizes will be awarded (approximate value 6000 Euros), one to each of the top 500 eligible entrants from Territory #2. Final ranking is calculated by combining points awarded based on each entrant's result-based ranking for each round of the Tournament.

    Wii Points are governed by Nintendo's Wii Points End User License Agreement, available at www.nintendo.com/consumer/systems/wii/en_la/privacyEULA.jsp . Wii Points are non-refundable and non-transferable.

    Odds of winning a prize depend on number of eligible entries received and your ability to obtain a top ranking in the Tournament. ALL FEDERAL, STATE, PROVINCIAL AND LOCAL TAXES (IF ANY) ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER.

    All prizes will be awarded unless returned as undeliverable or otherwise not claimed. Prizes returned as undeliverable or otherwise not claimed within ten (10) days after delivery of notification will be forfeited. Prizes are not transferable. No substitutions or exchanges (including for cash) of any Prizes will be permitted, except Sponsor reserves the right to substitute a prize of equal or greater value for any Prize. To the fullest extent permitted by law, all Prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).

    In the event of a dispute about the identity of an entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If requested by Sponsor, the potential winner must provide Sponsor with proof, to the satisfaction of Sponsor, that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.

  6. 6. Additional Rules.

    In multi-round Tournaments, the awards will be based on each eligible entrant's combined total results for each of the rounds of the Tournament. (As discussed above, an entrant's results from different rounds will only be combined if the "Confirmation Codes" are correctly submitted for each round.) In the event of a tie in ranking in a round, the last entrant to receive the ranking will win the tie. In the event of a tie based on the combined results, results from the last round any tied entrant participated in will be used to break the tie. Each potential winner will be notified based on the e-mail address s/he provided when registering for the Tournament. The e-mail notification will be sent within one (1) month after the Deadline for each Tournament. To claim a Prize, each potential winner must follow the instructions contained in his/her notification. If a potential winner cannot be contacted via the e-mail address s/he provided or does not respond in accordance with the Prize notification instructions, s/he will forfeit his/her Prize. Sponsor's records are final and conclusive.
  7. 7. General Release.

    General Release. By entering the Tournament, the entrant (and, if the entrant is a minor, the entrant's parents or legal guardians) release Sponsor, The Tetris Company LLC and all Participating Entities from any liability whatsoever, and, to the fullest extent permitted by law, waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Tournament or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional, contract, tort, warranty, negligence or other theory), except for those liabilities which cannot be excluded by law. To the extent permitted by statute, any liability of Sponsor arising from the breach of any conditions or warranties not able to be excluded, is at Sponsor's option, limited to and completely discharged:
        (a) in the case of the goods, by either:
            (i) the supply by Sponsor of equivalent goods; or
            (ii) the replacement by Sponsor of the goods supplied to the entrant; and
        (b) in the case of services, by supplying the services again.
  8. 8. Use of Winner's Name, Likeness, etc.

    Except where prohibited by law, entry into the Tournament constitutes permission for the Sponsor or the Participating Entities to use winners' name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation. As a condition of being awarded any prize, except where prohibited by law, if required by Sponsor, winners must execute a consent to the use of their name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation. By entering the Tournament the entrant consents to Sponsor's privacy policy available on the Website. Sponsor collects the entrant's personal information for the purposes of administering the Tournament, notifying and announcing the winner(s) and of marketing the Participating Entities' products and services, including by direct marketing techniques. Sponsor may disclose the entrant's personal information to third parties including those involved in the administration of the Tournament, notifying and announcing the winners, the supply of prizes, marketing companies, database collators and website servers. If the entrant does not provide the required personal information to Sponsor, the entrant cannot enter the Tournament. The entrant may access and correct the personal information about the entrant held by Sponsor by writing to Sponsor at the address below. By entering this Tournament the entrant consents to: the collection, use and disclosure of his or her personal information as set out in this paragraph 8.
  9. 9. Affidavit & Release.

    If requested by Sponsor, as a condition of being awarded any prize, winners (and if winner is a minor, winner's parent or legal guardian) must execute and deliver to Sponsor a signed affidavit of eligibility and acceptance of these Official Rules and release of liability in a form to be determined by Sponsor.
  10. 10. Winners List; Rules Request.

    For a copy of the winners list for a Tournament, send a stamped, self-addressed, business-size envelope within three (3) months after the applicable Deadline to Sponsor at the address listed below, Attn: Tetris Party Tournament Winner's List. To obtain a copy of these Official Rules visit http://www.tetrisparty.com/tournament or send a stamped, self-addressed business-size envelope to Sponsor at the address listed below, Attn: Tetris Party Tournament Contest Rules Request. Territory #1: Residents of Vermont may omit return postage.

  12. 12. Miscellaneous.

    Miscellaneous. The Tournament and these Official Rules will be governed, construed and interpreted under the laws of the state of Hawaii, or for Territory #2, of England and Wales. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Tournament or any entrant's participation in the Tournament should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the Tournament, or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Tournament as planned. Sponsor reserves the right to validate and check the authenticity of entries and Confirmation Codes. Entrants who violate these Official Rules, tamper with the operation of the Tournament or engage in any conduct that is detrimental or unfair to Sponsor, the Tournament or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Tournament. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Tournament.
